Hercy Miller, the son of hip-hop icon Master P, is one step closer to getting his name cleared in the bizarre refrigerator theft case.
According to TMZ, prosecutors have filed a motion to dismiss the felony charge against him.
A spokesperson for the Iron County Attorney’s Office reportedly submitted the request in court on Friday (December 6th). If the judge ultimately signs off on it, Miller will officially be in the clear.
A formal ruling on the matter is expected to come down by the end of the next week.
As People reported on Thursday (December 5th), Miller and two of his Southern Utah University Thunderbirds teammates, Brock Felder, 20, and Peter Dadson Jr., 25, were arrested on November 27th on one count of theft.
Arrest documents obtained by the news outlet showed that the men stole two refrigerators, worth $1500 each, from the loading dock of the Cedar City, Utah, school’s campus bookstore.
Security footage captured the athletes hauling the fridges into their vehicles on November 11th.
Dadson Jr. and Milled informed authorities that they assumed the fridges were being thrown away because they had been on the loading dock for over a month.
“[Dadson Jr.] said that he believed they were being thrown away and that it was OK to take them,” the documents stated.
The three were booked into Iron County Jail and were later released on November 28th. Their basketball head coach told TMZ the incident was a mix-up and “the university is working to get this thing resolved quickly.”
Miller is in his first year at SUU after transferring from Louisville last season. The six-foot-three-inch guard is averaging 8.8 points per game.
