Better late than never.. right? According to BET Tory Lanez is once again appealing his 10 year sentence. The Canadian rapper has filed a new appeal to overturn his conviction.
Law and Crime reporter Meghann Cuniff reported that attorneys representing Lanez filed the appeal on grounds of “erroneous admission of evidence” and “prosecutorial misconduct,” in the 103-page document.
“The arguments largely match arguments made in his motion for a new trial that Los Angeles County Superior Court Judge David Herriford rejected in May,” Cuniff wrote.
“The filing builds on a habeas petition filed in December with a declaration from Lanez’s driver that says he saw Lanez try to take a gun away from Megan’s friend Kelsey Harris before the shooting occurred, but it also says the driver did not see who fired the shots,” Cuniff continued.
According to Lanez’s lawyers, “prosecutors made multiple improper appeals to emotion and sympathy” for Megan during closing arguments, “which should have had no bearing” in determining if Lanez had been innocent or guilty of the charges.
“Sympathy for the victim is out of place during an objective determination of guilt,” Lanez’s lawyers said.
During the trial, Megan testified that Lanez had shot at her feet and “yelled at her to dance” as she exited an SUV following a party at Kylie Jenner’s home.
Megan, who at first did not identify Lanez as the shooter, said she needed surgery to remove bullet fragments from her feet in her testimony.
“Since I was viciously shot by the defendant, I have not experienced a single day of peace,” Megan said in a statement before Lanez was sentenced. “Slowly but surely, I’m healing and coming back, but I will never be the same.”
The response brief of the appeal is due on March 27 in the 2nd District Court of Appeal in Los Angeles.
Kelsey Nicole’s New Interview
Recently Kelsey Harris made the news speaking out for the first time in a new interview expressing her frustrations about what happened the night of the shooting.
According to Yahoo while appearing on The Danza Project podcast — which will premiere an exclusive two-hour long interview with her on March 3 — Harris revealed shocking details about Thee Stallion and her alcohol consumption that night, her intuition before the shooting, and whether surveillance footage exists or not.
“That morning, I woke up and I had said a prayer. ‘If there’s something not for me, show me that.’ That night, it was destruction,” she could be seen and heard saying in a teaser. Harris also alluded to Thee Stallion’s behavior while intoxicated, recalling, “When it comes to a point where alcohol takes over, and you become a different person, it’s time to let that sh*t go. Everybody’s life that night changed.”
When one of the hosts asked about any videos from that night that could either help or hurt Lanez, Harris didn’t deny it. “I’m positive there was a video; there had to have been one. You’re in LA, you’re in Hollywood,” she said.
She also doubled-down on the many comments out there that Meg had been messing around with Lanez behind Harris’ back. In 2022, the “Savage” rapper originally stated to Gayle King that she hadn’t been intimate with Lanez and it was later revealed that she was.
“It did end up coming out that night that she had been betraying me,” Harris admitted. “Believe it or not, that was my last time ever seeing her.”
